Patrocinio A. Lachica Integrated School (Formerly Cortes Integrated School) Cort

The latest ordinance enacted by the Sangguniang Bayan of Balete, Aklan (July 6, 2017; approved by the Mayor on July 17, 2017) is to honor the memory of the lot donor of the school site herein named and renamed.

RENAMING THE CORTES INTEGRATED SCHOOL INTO PATROCINIO A. LACHICA INTEGRATED SCHOOL (FORMERLY CORTES INTEGRATED SCHOOL)

Rationale:

The Sangguniang Barangay of Cortes, Balete, Aklan recommended to the Sangguniang Bayan the request of the GPTA of Cortes Integrated School to rename the school in honor of the lot donor and to ingrain a spirit of gratitude in the consciousness of the later generations who are now benefiting the gratuitous act made several decades ago. The late Patrocinio A. Lachica served the people of Balete, Aklan (Capiz then) as Municipal Councilor from 1946-1955 as the Vice Mayor thereof when Aklan separated from Capiz in 1956. He served in such capacity until 1959. In 1954, while serving as Municipal Councilor, he donated 10,000 square meters lot in the upland barrio of Cortes to serve as site for Corte Primary School which later elevated to become Cortes Integrated School that now cater complete elementary and secondary education to pupils and students from the upland barangays of Cortes, Guanko and Oquendo. The honoree was a WWII Veteran and a bronze awardee with an Asiatic Pacific Campaign Medal.

In compliance to the provisions of the Revised Guidelines in the approval or disapproval in the naming and renaming of streets, plazas, public schools, etc., the Municipal School Board of the Municipality of Balete, Aklan has adopted in March 7, 2017 a resolution endorsing the renaming of the said school into “Patrocinio A. Lachica Integrated School.  Then, on May 26, 2017, the National Historical Commission of the Philippines through Acting Executive Director Ludovico D. Badoy expressed its no objection to the proposal although recommended that the old name, “which has been sanctified by usage by the residents of the community, be placed underneath the new name in the signage as follows:

Section 13(e)) of the Local Government Code of 1991 expressly grants power to the local Sanggunian to change the name of a public school within its jurisdiction only upon the recommendation of the Local School Board concerned.

NOW THEREFORE:

Be it ordained by the Sangguniang Bayan that:

Section 1. Cortes Integrated School located in Barangay Cortes, Balete, Aklan is hereby renamed into Patrocinio A. Lachica Integrated School (formerly Cortes Integrated School).


Section 2. This ordinance shall take effect 15 days after its posting in conspicuous places in the municipality.

DECLARING MRS. JONALYN S. DELA CRUZ, MLGOO I, AS PERSONA NON GRATA IN THE MUNICIPALITY OF BALETE, AKLAN

            WHEREAS, the Municipal Local Government Operations Officer assigned in this municipality in the person of Mrs. Jonalyn S. Dela Cruz has admitted in open session that she has inconspicuously attempted to secure a copy of the Statement of Assets, Liabilities and Networth (SALN) of former Mayor Teodoro V. Calizo, Jr. without the expressed consent of the latter;

            WHEREAS, under the Data Privacy Act of 2012, securing personal information of public officials outside of the repository agencies needs the expressed consent of the data subject;

            WHEREAS, the repository agency for the SALN of local government officials and employees as prescribed under Civil Service Commission Resolution No. 1500088, dated January 23, 2015 is the Office of the Deputy Ombudsman for Visayas which has its own established rules governing the access to such personal data of those public officials and employees;

            WHEREAS, the status of former Mayor Teodoro V. Calizo, Jr. in the Local Government Unit of Balete falls into the category of an honorary member as his services as consultant are rendered gratis et amore, i.e., without service credit and without pay, making him per Republic Act 6713 (Code of Conduct and Ethical Standards for Public Officials and Employees) exempted from filing his SALN;

            WHEREAS, considering the many years of service Mrs. Jonalyn Dela Cruz has rendered as MLGOO of this municipality, she was gently and fraternally advised by this august Body to mend her ways as her action is clearly illegal but her impertinence was at its apex whereby she rebuffed the members of this Sanggunian saying that she will not justify her action yet qualifying that she was just dispensing her duties and responsibilities as MLGOO, having been directed by her Provincial Director, John Ace Azarcon, to conduct a “discreet” fact-finding over an anonymous complaint made through CSC Contact Center ng Bayan (CCB) hotline;

            WHEREAS, conducting discreet inquiries and the acquisition of personal data through illegal means are not part and parcel of the duties and responsibilities of MLGOO as the role rests on Lawrence Sander’s fictional character, Archibald McNally;

            WHEREAS, Mrs. Jonalyn S. Dela Cruz need not have to conduct discreet inquiries to determine the merit of the complaint as she knows for a fact, having rubbed shoulders with the local officials and employees of Balete for many a number of years now, the many feathers in their cap as public and civil servants of the Local Government Unit, let alone, having championed and supported all the programs of the DILG thereby earning recognitions and awards as early as 2010 such as the Seal of Good Housekeeping (SGH) and the Seal of Good Local Governance (SGLG) that zeroed in on the principles of transparency, accountability and good governance. Earlier on, it was a consistent winner of the Regional Excell Awards, also of the DILG;

            WHEREAS, Mrs. Jonalyn S. Dela Cruz, being privy to the developmental changes that took place in Balete over the years, would have dismissed the complaint right away as malicious for the following facts:
1.    Teodoro V. Calizo, Jr. is no longer the Mayor of Balete when the complaint was made in April 3, 2017 as he opted to be substituted by his son after serving the people of Balete for more than fifteen years. In his 5 terms as Mayor, he ran unopposed for the last four succeeding terms. Even before as he sought of the Office of the Vice Mayor prior to his mayorship, he ran unopposed.
2.    With the recent recognition of Balete having ranked 5th in the entire Region VI for the 2017 Seal of Good Local Governance would dispute the allegation that “hindi maganda ang pamamahala ng Mayor na si Teodoro V. Calizo, Jr. Ang pera na para sa bayan ay hindi nagagamit nga tama rito sa amin dahil walang improvement dito sa lugar.” It is either the SGLG evaluators that gave very satisfactory grade to the current administration are lying to through their teeth or the complainant is blind (or malevolent) not to see the many developments that have had happened in the municipality over the years;
3.    That these many developments took place during the tenure of former Mayor Teodoro V. Calizo, Jr. include the following:
a.     The establishment of Balete Community College, a tertiary institution affording cheap but quality education for poor students. Since 2004, it has produced professionals most of whom are now employed by DepEd as educators
b.    The establishment of 24/7 Birthing Clinic and Medical Laboratory under the Municipal Health Office, making it the first in Aklan to have attained Zero Maternal and Child death for many years now
c.     The improvement of road network system in barangays of Balete making up for more than 30 kilometers of concrete road pavement
d.    The upgrading of school facilities such as science and computer laboratory, school buildings and other devices/equipment for the National High Schools in Balete (grant-loan through the LOGOFIND subproject)
e.     Access to Level II potable water in the poblacion, portions of Barangay Feliciano, Fulgencio, Calizo, Arcangel, Morales, Cortes and Aranas
f.      The constructions of facilities such as the Mayor Teodoro F. Calizo, Sr. Memorial Civic Center, the Mayor Miguel F. Calizo Multi-purpose Building, the improvement of the Balete Public Market
g.     The acquisition of several units of rescue vehicles and heavy equipment such as dump trucks, road grader, backhoe and bulldozer
h.    The prompt implementation of all BUB and KC-NCDDP projects under his watch

4.    That Teodoro V. Calizo, Jr., belongs to the landed gentry who was not only recognized by the Province of Aklan as an outstanding taxpayer but rather was conferred with a Hall of Famer award for his consistency in religiously paying his obligations for himself and for those whose property he administered.
5.    In his 24 years of public service, former Mayor Teodoro V. Calizo, Jr. has never been charged with any criminal or administrative case.

            WHEREAS, Mrs. Jonalyn S. Dela Cruz also disclosed that when she was unable to get hold of a copy of his SALN, she photocopied a number of Certificate of Awards and Recognitions as Outstanding Taxpayer of the latter she found at his former office at the Town Hall of Balete after ransacking it and presented them to her Provincial Director, John Ace Azarcon, again without the knowledge and consent of the data subject;

            WHEREAS, Mrs. Jonalyn S. Dela Cruz displayed partiality in dealing with the anonymous complaint wherein she refused the former Mayor first-hand information on the matter and yet personally and openly discussed it with the Municipal Engineer who happened to be one of the subjects of the complaints (see attached photocopy of the complaint) and for which she was granted his consent to use his personal information for the so called discreet fact-finding mission of hers;

            WHEREAS, Mrs. Jonalyn S. Dela Cruz has displayed unprofessionalism in dealing with that specific complaint for while initiating discreet inquiries and soliciting information through illegal means she failed to act promptly on it in contravention to Section 5(d) of Executive Order No. 6 which directs  to “have a concrete and specific action within 72 hours from the receipt of the concern by the proper government agency or instrumentality” thereby sending wrong perception of her roles as dispenser or peddler of undue patronage. She had with her the copy of the transcript of complaint as early as the first week of June 2017 but has been soliciting information even when the prescribed time has lapsed;
The Memorandum of Dir. Nuyda of DILG

            WHEREAS, nowhere in the Memorandum of Regional Director Anthony Nuyda of the DILG (see attached copy hereto attached) did it instructed her to conduct “discreet” inquiry or to secure illegally the SALN of former Mayor Calizo as the instruction is plainly to conduct fact-finding;

            WHEREAS, the worries of this Sanggunian lies on the arbitrariness of the discretion of the MLGOO of illegally processing the personal data of former Mayor Teodoro V. Calizo, Jr. that if it remains unchecked can embolden Mrs. Jonalyn Dela Cruz to habitually trammel other officials and employees under the pretext of resolving an anonymous complaint;

            WHEREAS, the villainous act of Mrs. Jonalyn Dela Cruz coupled by her impertinence makes no room of protracting her quotidian excursion here in the municipality.

            NOW THEREFORE, BE IT RESOLVED as it is HEREBY RESOLVED on motion unanimously made by the present members of this Sanggunian in session assembled, TO DECLARE as it is HEREBY DECLARED MLGOO Jonalyn S. Dela Cruz as persona non grata in the Municipality of Balete, Aklan.

            RESOLVED FURTHER, lest it may be misunderstood, the sentiments herein expressed is directed solely and exclusively to the action of Ms. Jonalyn S. Dela Cruz of attempting to illegally secure a copy of the SALN of a former official of the Local Government Unit of Balete and not against her office.

            RESOLVED FURTHERMORE, that copies of this resolution be furnished the following agencies / departments for their information:

Balete: Fast Facts



·        Balete was founded as a “pueblo” or Municipality in 1804[i] during the Spanish time. Then one of the 33 pueblos of the Province of Capiz. It had 3,089 souls. Well-loved tales of the past tell us that Balete got its name from the Balete tree growing at the heart of the town.

·        The Municipality of Balete is a 4th class municipality located in the eastern part of the Province of Aklan. It is located 21 kilometers (km) southeast of the capital town of Kalibo where an international airport is located. It is 106 km southeast of Caticlan, the gateway to Boracay; 35 km away from Dumaguit, New Washington, the commercial seaport of the Province of Aklan; 65 km north of Roxas City, the capital of the province of Capiz where an airport is also located and 155 km north of Iloilo City, the regional capital of Western Visayas. The road arteries connecting these places to Balete are well paved and part of the Philippine Nautical Highway. Transportation is serviced by bus and other public utility vehicles with daily trips from Cubao to Iloilo and vice versa via the roll on-roll off scheme transportation facilities.
·          The Municipality has a total land area of 11,760 hectares and made up of ten (10) barangays from which nine (9) are situated in a mountainous area. It is thus considered a Geographically Isolated and Depressed Area (GIDA) by DOH with a poverty incidence of 56%.

·       It has a population of 27, 197[iii] per 2010 Census of Population and Housing. Its density ratio is 3 persons for every 1 hectare of land. It has a projected labor force of 10.70 thousand as against child-dependent of 9.11 thousand by 2016
